Five cases were consolidated for trial, all claims for damages to a tavern building and contents by a semi tractor-trailer
driven by defendant Arnold E. Princl and insured by defendants Hartford Accident and Indemnity Company and Fidelity and Casualty
Company of New York. Suits were brought by plaintiff Lucy Maccaux, owner of the tavern building; by plaintiff Allen J. Wickenberg,
tenant and proprietor of the tavern business; and by plaintiffs Cream City Mutual Insurance Company, The Mutual Fire Insurance
Company, Herman Mutual Insurance Company and Underwriters Insurance Company, all of which became subrogated to their insureds'
rights to the extent of payments made under their respective policies on the building, contents, fixtures and personal property.
On the special verdict of a jury finding the defendant Princl not negligent, judgments were entered dismissing the complaints,
and from said judgments the plaintiffs appeal. The facts will be stated in the opinion.
